A MIDNIGHT prowler who sexually assaulted a mother and her 14 yr old teenage daughter as they slept had his sentence cut by the Court of Appeal.
Jason Moulding, pictured, of Meadowcroft, Upper Stratton, was jailed for five years in July last year at Swindon Crown Court after admitting two counts of sexual assault, and trespass with intent to commit a sexual offence.
In recognition of the danger he posed, the 32-year-old was also given a five-year “extended licence” period, during which he could be closely monitored and recalled to prison if he put a foot wrong after his release.
But Moulding appealed against the length of his sentence.
Mr Justice Maddison, sitting in London’s Appeal Court with Lord Justice Toulson and Mr Justice Hickinbottom last week, said Moulding crept into his victims’ Stratton home in the early hours of December 21, 2008, molesting each by turn.
The teenage victim woke to the terrifying sensation that someone was in her room. She saw that Moulding was leaning by her bed, and he fondled her thigh and breast.
When the girl screamed, Moulding clamped his hand over her face and pushed her head onto the pillow before running from her room.
Her father, who had also been asleep, heard the girl’s cries and chased Moulding from the house, the court heard.
Mr Justice Maddison said the intrusion and attacks had taken a devastating toll on the family, leaving them anxious and angry at the violation of their privacy.
The girl was “unable to sleep in the same bed”, the court heard.
Moulding claimed to have “blacked out” before committing his crimes, due to excessive drink, but he also told a psychiatrist that a voice in his head had told him to attack his victims.
The judge said his offences had “significant aggravating factors” and merited “substantial custodial sentences”.
But the total sentence was “too long” in light of Moulding’s lack of previous sexual offences, said the judge – “very serious although the offences were”.
He cut both Moulding’s custodial term, and the extended licence period, to four years.
July 2009 – Paedophile gets five-year sentence
A MAN who crept into a family home and sexually assaulted a 14-year-old girl and her mother has been jailed for five years.
Jason Moulding, 31, from Meadowcroft, Upper Stratton, appeared at Swindon Crown Court yesterday having pleaded guilty to trespass with intent to commit a sexual offence, sexual assault and sexual activity with a child.
Claire Marlow, prosecuting, told the court the family were asleep in the early hours of Sunday, December 21, when Moulding entered through an unlocked back door.
Moulding committed sex acts on both the mother and daughter but fled the house when the father was woken by his daughter’s screams.
Moulding was tracked down after his DNA was found in semen left in the house, Miss Marlow said.
Robin Shellard, defending, said a psychiatric report had been compiled on his client as well as a pre-sentence report from the probation service.
He said his client was suffering from mental health problems which were deteriorating before the offence was committed.
Jailing him Judge Douglas Field said: “This is a very serious matter and there are very serious aggravating features in what happened on the night in question.
“In the small hours of the morning when that family were asleep you gained access to their premises.
“You clearly gained access to intend to commit sexual offences and you disconnected the phone in order to prevent them from telephoning the police.
“You then went upstairs and there was the daughter fast asleep in her bed aged 14.
“She woke from this deep sleep to see this strange man by her bed side.”
Judge Field banned Moulding from ever working from children and ordered him to sign the sex offenders’ register for life.
Moulding, who has a distinctive star tattoo on his neck, will also have to spend a further five years on licence after he is released from custody.
