Man avoids jail after filming himself having sex with schoolgirl

A 20-year-old man has avoided jail after filming himself having sex with a girl under the age of 16.

Nathan Kyrnyckyj, of Ivy House Court, Bottesford, admitted three counts of sexual activity with a child, two of taking indecent photographs of a child and one of criminal damage after having consensual sex with the girl.

Grimsby Crown Court heard Kyrnyckyj filmed himself having sex with the girl on his mobile phone before uploading the images to his laptop.

Prosecuting, Jeremy Evans said: “This was a female who needed protecting.

“Concerns were raised about this defendant when she went to a sexual health clinic.

“He had sexual intercourse with her on a number of occasions.”

After a criminal damage complaint was made to police, Kyrnyckyj’s phone and laptop were seized.

He told police about the videos before asking if they could be deleted and whether they could “leave it at that”.

Mr Evans said the images had not been viewed or distributed to anybody else, but the defendant’s housemate did have access to the pictures.

Defending, Richard Lunn, said Kyrnyckyj had no previous convictions.

He said: “The defendant has made a catastrophic mistake born out of naivety.”

Describing Kyrnyckyj as an “immature young man”, trial judge Recorder Sophie Drake said: “The law is there to protect girls like her.

“She is in no way to blame.”

Kyrnyckyj received an 18-month prison sentence suspended for two years, was ordered to carry out 150 hours of unpaid work, take part in a sexual offender’s treatment programme and was given a restraining order forbidding him from contacting the girl.
