Suspended jail for Donegal man who assaulted partner’s son and mother
A Donegal man who assaulted his partner’s son and mother has received a suspended sentence.
Kevin Cummings, of Carrickmaquigley, Redcastle, Co. Donegal, pleaded guilty to common assault on February 4.
Derry Magistrate’s Court heard that the 28-year-old was intoxicated when he turned up at the woman’s house in Derry.
Her children began screaming because the defendant was ‘roaring and shouting at them’.
The woman’s five-year-old sold told her Cummings had pushed him and hurt his arm. He had a scratch on his arm.
The woman’s mother tried to get the defendant out of the house and he pushed her and punched her in the face.
During police interview, Cummings said he had been drinking for hours and had no recollection of the incident.
Defence solicitor Walter Hegarty said his client spent two weeks in custody following his arrest and that had been a ‘salutary lesson for him’.
Suspending a three month sentence for 18 months, District Judge Peter King said Cummings ‘completely destroyed what could have ended up as a relationship’.
