Derby pervert asked 11-year-old girl for photo of her breasts

A Derby pervert sent a photo of his private parts to an 11-year-old girl and asked if he could be her boyfriend.

Derby Crown Court heard how Jack Franklin also requested pictures of her breasts in return but his messages were found by her older sister.

That sibling then pretended to be another young girl and the 20-year-old defendant, of Oakwood, began asking her if they could meet and kiss.

And five years ago Franklin of Amesbury Lane, was handed a police caution for carrying out the exact type of behaviour.

Handing him a two-year community order, Recorder William Harbage QC said: “This was for the purposes of sexual gratification, you admit that through your pleas of guilty.

“You clearly have some interest in pre-teen girls but in a victim impact statement, it seems there is no particular lasting effect on the girl.

“But this sort of conduct can affect young girls for many years and you are fortunate she does not seem to be adversely affected to a significant degree.

“Your pre-sentence report refers to you as being a high risk of re-offending and in my judgement that will remain until you start to face up to what was going on here.

“The best way of doing that is for you to get some outside help.”

Ian West, prosecuting, said the offending took place when Franklin was 19 and the girl was 11 for a near three-week spell in 2019.

He said the two started chatting online through different platforms and then began exchanging messages over WhatsApp.

Mr West said: “He started asking her questions about being her boyfriend saying ‘can I go out with you?’.

“There were 215 messages between March 24 and April 8 and included was him sending an image of his private parts to her and asking her for a picture of her boobs.

“The only photograph she did send was an edited picture of herself as a puppy dog with a tongue and ears.”

Mr West said the girls older sister found the phone and saw the message and started communicating with Franklin under a different name and he asked her if she would meet him and asked if they could kiss.

He was arrested, interviewed, charged and later pleaded guilty to charges of sexual communication with a child, attempted sexual communication with a child and attempting to cause a child to watch a sexual act.

Mr West said although he has no previous convictions, the defendant does have a previous caution dating back to 2015 when he asked a different 11-year-old girl to send him nude photographs of herself and sent her a photograph of his private parts.

As part of the community order, Franklin must attend a 90-day sex offender programme and carry out 30 rehabilitation sessions with the probation service.

He was also ordered to undertake 150 hours of unpaid work and was handed a five-year sexual harm prevention order.

Franklin will be on the sex offender register for five years.
